On March 26, 2015, the Ontario Energy Board released a report on changes to its rate-making policies that it will adopt in order to support consolidation of Ontario’s electricity distributors. The Board’s report followed a consultation process to consider changes to regulatory requirements that may facilitate efficiency improvements.

Increased Requirements for Consumer Water Heater Transactions

In response, the Ontario government passed amendments to the Consumer Protection Act, 2002 (the “Act”) to allow for enhanced disclosure and consumer rights for water heater rentals.

Alberta Utilities Commission Reduces Utility Cost of Capital

In a March 2015 decision, the Alberta Utilities Commission (AUC) set the generic cost of capital for 2013 to 2015 for the utilities that it regulates. In the decision, the AUC reduced cost of capital parameters applicable to the utilities that it regulates. This decision will most likely be cited and reviewed if and when the Ontario Energy Board (OEB) proceeds with its promised cost of capital review.
